This page is a placeholder draft, not a binding legal document.
It has not been reviewed by an attorney. Do not rely on it for any real
commercial engagement, regulatory filing, or customer contract until
qualified counsel has reviewed and approved final language for your
jurisdiction(s) and use case.
Terms of Service (draft)
- Nature of the service. Med Mal Score is a demonstration environment providing a supplemental, explainable malpractice-risk signal computed from public Medicare billing data (2024 Maryland slice) and published malpractice-claims research. It is not a licensed insurance product, actuarial opinion, or legal/medical advice.
- Not a sole underwriting basis. Scores must not be used as the sole basis for any underwriting, credentialing, employment, or coverage decision. See the Methodology page for full limitations.
- No warranty. The service is provided "as is," without warranty of any kind, express or implied, including accuracy, completeness, or fitness for a particular purpose.
- Limitation of liability. To the maximum extent permitted by law, the operator is not liable for any damages arising from use of, or inability to use, this service.
- Access. Demo access is controlled by a shared access code. This is an access-control convenience, not a security guarantee -- see the Methodology page.
- CPT® codes. CPT code numbers with CMS-provided short descriptions are used for analysis of public data; the AMA's licensed long-form CPT descriptor set is not bundled or distributed.
Privacy Policy (draft)
- No individual patient data. This service never processes individually identifiable patient health information. All data is physician-level (public NPI) and claims data used here is aggregate/de-identified (NPDB Public Use Data File).
- Physician data is public. Billing history summarized here originates from CMS's own public Medicare Physician & Other Practitioners release; nothing here is drawn from a non-public source.
- Operational logs. The demo records a basic audit log of which NPI was queried, when, and the resulting status, for operational visibility. No payment, contact, or account information is collected because no accounts exist in this demo.
- Cookies. One functional, non-tracking cookie is set after a correct access-code entry, to avoid re-prompting on every page. No analytics or advertising cookies are set.
- Data retention. The underlying Medicare/NPDB dataset is refreshed by redeployment, not by live customer data collection; there is no live customer data to retain or delete.
